Sen. Marsha Blackburn has sued the former special counsel, accusing him of secretly obtaining her phone records and “conspiring” to violate her constitutional rights.
Blackburn claims Smith targeted records from a phone she used for legislative business during his 2020 election investigation, revealing who she called and when.
She also alleges investigators secured a nondisclosure order that kept her from challenging the subpoena.
Smith previously admitted approving congressional toll-record subpoenas, testifying: “I approved these subpoenas, yes.” He has maintained his investigative actions followed the law.
Now the prosecutor is the one facing court.

Fox News Apologizes for 9/11 Footage During Hijacked Plane Report
Fox News just learned the hard way that b-roll can bite back.
During a report by Jeff Paul on a FlyDubai jet diverted to Saudi Arabia after the co-pilot allegedly stabbed the pilot, Fox & Friends flashed footage labeled “SHANKSVILLE, PA Sept. 11, 2001.”
About 30 minutes later, co-host Brian Kilmeade stepped in. “We aired some footage unrelated,” he told viewers. “We apologize for any confusion.”
Critics were not in a forgiving mood. “Yup, Faux Entertainment never ceases to amaze,” one person tweeted. Another fumed, “Your ‘I’m sorry’ is BS. Shame on you.”
Fox got the breaking news, but the internet got the receipts.

Reality TV Star Pleads Guilty to Animal Sex Acts & Child Exploitation Material
Tony McCollister, the Ohio man who appeared on A&E’s swinger series Neighbors with Benefits, has pleaded guilty to 17 counts as his bench trial got underway.
The 43-year-old admitted to 13 counts involving explicit material of a minor and four involving sexual conduct with animals. Authorities were first tipped off in June 2025, when Google flagged material tied to his IP address and alerted the National Center for Missing and Exploited Children.
He isn’t done in court. He still faces trial on separate charges that he and ex-girlfriend Erica Grove drugged and abused a child under six. Grove pleaded guilty to similar charges last week, though a judge dismissed several of the more serious counts for lack of evidence.
Prosecutor David Fornshell said of the case: “It’s really difficult to even process.”
Both are due back in court for sentencing in November.
