Attorney Keith B. Johnson broke it down for KEEPING TABS: “The intersection of free speech and employment law is complex. While the First Amendment protects individuals from government censorship, it does not shield private employees from consequences imposed by their employers for speech, especially if that speech violates company policies, creates workplace disruption, or damages the employer's reputation.”
He added: “Freedom of speech doesn’t always mean freedom from consequence.”
Among the firings: Middle Tennessee’s Assistant Dean Laura Sosh-Lightsy, who allegedly posted, “Looks like ol' Charlie spoke his fate into existence. Hate begets hate. ZERO sympathy.” A Tennessee professor called Kirk a “disgusting psychopath,” and American Airlines pilots mocking the killing were grounded on the spot.
Now the big question is whether the axed employees can really fight back in court.

Jimmy Kimmel has been axed from ABC’s lineup after blowing up controversy with comments about Charlie Kirk’s death.
At the start of his September 15 monologue, the 57-year-old comedian blasted the “MAGA gang,” saying: “We hit some new lows over the weekend with the MAGA gang desperately trying to characterize this kid who murdered Charlie Kirk as anything other than one of them and doing everything they can to score political points from it.”
Furious Nexstar Media declared its 200+ stations would “preempt Jimmy Kimmel Live! for the foreseeable future.” ABC quickly followed, admitting the show would be “preempted indefinitely.”
FCC Chairman Brendan Carr ripped Kimmel’s remarks as “truly sick” and threatened “immediate action” against ABC and Disney, warning: “We can do this the easy way or the hard way.”
